3. Trade Marks
(1) Application may be made to the Registrar of Trade Marks requiring him to conduct a search in the Register of Trade Marks for ascertaining the existence of any previous registration or application for registration of an identical or resembling trade mark.
(2) Furthermore the Registrar may be requested to advise as to whether a trade mark fulfils the distinctiveness test and is prima facie acceptable for registration and, if so, whether any conditions are contemplated to be imposed for its registration.
(3) Two prints of the mark for which a search is required should be attached to the applications, where the mark is not a word mark.
